Terms of Service

Welcome to Plan for Adventure ("we," "us," or "our"). By accessing or using our website at planforadventure.com, the web application at app.planforadventure.com, the MCP server, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Description of Service

Plan for Adventure is an AI-powered overland trip planning platform. The Service provides access to the Adventure Atlas (a curated database of GPS waypoints enriched with terrain, vehicle access, solitude, and other contextual data), trip planning tools, route computation, weather data, and AI-assisted planning through both a web interface and an MCP (Model Context Protocol) server.

2. Eligibility and Account Registration

You must be at least 18 years old to use the Service. You must create an account by authenticating through our supported identity provider (currently Google via Auth0). You are responsible for maintaining the security of your account credentials and for all activity under your account.

You agree to provide accurate information during registration and to keep your account information current. We reserve the right to suspend or terminate accounts that we reasonably believe contain false information or are being used in violation of these Terms.

3. Subscription Plans and Billing

3.1 Tiers

The Service offers multiple access tiers:

3.2 Billing

Paid subscriptions are billed annually through Stripe. By subscribing, you authorize us to charge your payment method on file. Subscriptions auto-renew unless canceled before the renewal date.

3.3 Cancellation and Refunds

You may cancel your subscription at any time through the Stripe customer portal. Cancellation takes effect at the end of the current billing period — you retain access to paid features until then. We do not offer prorated refunds for partial billing periods. If you believe you were charged in error, contact us within 30 days.

5. Data Accuracy and Synthetic Reference Data

The Adventure Atlas aggregates data from government agencies (USFS, BLM, NPS, recreation.gov, and others), OpenStreetMap, and curated community sources. We enrich this data with terrain analysis, vehicle suitability assessments, solitude estimates, and other contextual signals using geospatial computation and publicly available reference data sets.

We do not guarantee the accuracy, completeness, or timeliness of any data in the Service. Conditions on the ground change — roads wash out, land management policies shift, water sources dry up, and access restrictions are imposed or lifted without notice. Always verify conditions locally before traveling, especially for remote or off-road destinations. Carry appropriate maps, supplies, and safety equipment.

Plan for Adventure may include a small number of synthetic reference records within the Adventure Atlas for security, testing, and audit purposes. These records are filtered from all normal browsing surfaces and are not part of the public waypoint inventory. They exist solely to detect unauthorized automated access to the data set and should not be relied upon for navigation.

6. User Content and Personal Data

Certain features allow you to upload personal data (GPX files, CSV waypoints) and create trip plans. You retain ownership of content you upload. By uploading content, you grant us a limited license to store, process, and display it to you within the Service.

We do not sell your personal data. We use Auth0 for authentication, Stripe for billing, and Mapbox for map rendering — each of which has its own privacy policy. We may collect anonymized usage data (page views, feature usage) for product improvement using self-hosted analytics (Umami) that does not use cookies or track individuals across sites.

7. Intellectual Property

The Service — including its software, design, brand assets, enrichment algorithms, and the curated compilation of Adventure Atlas data — is our property or is used under license. Government-sourced data remains in the public domain; our enrichment, curation, and presentation of that data is proprietary.

These Terms do not grant you any right to use our trademarks, logos, or brand name ("Plan for Adventure," "Adventure Atlas") without prior written consent.

8. Third-Party Services

The Service integrates with third-party providers including Auth0 (authentication), Stripe (billing), Mapbox (maps and geocoding), the National Weather Service (weather data), and BRouter (route computation). These integrations are provided as-is. We are not responsible for the availability, accuracy, or terms of any third-party service.

9. MCP Server and AI Integration

The MCP server provides programmatic access to Service features for use with AI assistants (Claude, ChatGPT, Gemini, and others). MCP access is subject to the same acceptable-use rules and tier restrictions as the web interface. Automated access through the MCP server must be associated with an authenticated user account and is subject to rate limits.

AI-generated trip plans, site analyses, and recommendations are informational only. We do not guarantee their accuracy or suitability for any particular purpose.

10. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOST PROFITS, OR PERSONAL INJURY ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON ANY DATA IT PROVIDES.

Overland travel involves inherent risks. You are solely responsible for your safety when traveling to locations identified through the Service. Plan for Adventure does not assess or guarantee the safety of any waypoint, route, or campsite.

11. Indemnification

You agree to indemnify and hold harmless Plan for Adventure, its owner, and its agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our sole discretion. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive (limitation of liability, indemnification, intellectual property) will survive termination.

13. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page with an updated effective date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify you (such as an in-app banner or email to your registered address).

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Maricopa County, Arizona.
